Privacy Policy

1. Introduction

Ultimate Quantum LLC ("Company," "we," "us," or "our") operates UltimateNexus.ai (the "Platform" or "Service"). This Privacy Policy describes how we collect, use, disclose, store, and protect your personal information when you use our Platform, visit our website, or otherwise interact with us.

This policy explains our data practices. It does not replace any consent required by law or authorize you to upload or contact people without an appropriate legal basis.

2. Information We Collect

2.1 Information You Provide Directly

  • Account Information: Name, email address, company name, job title, phone number, billing address, and payment information when you create an account or join our waitlist.
  • Profile and Business Data: Brand identity information, website URLs, industry, business goals, target audience descriptions, and other information you provide during onboarding and project configuration.
  • Content and Marketing Data: Content you create, upload, or generate through the Platform, including images, videos, text, brand assets, marketing copy, ad creatives, email templates, and campaign configurations.
  • Contact and Lead Data: Information about your contacts and leads that you import or that is collected through Platform integrations, including names, email addresses, phone numbers, engagement history, and any custom fields you define.
  • Communications: Messages, feedback, support requests, and any other communications you send to us or through the Platform, including voice interactions with the AI team.
  • Payment Information: Credit card numbers, billing addresses, and other financial information necessary to process payments. Payment processing is handled by third-party processors (e.g., Stripe); we do not store complete payment card numbers on our servers.

2.2 Information Collected Automatically

  • Usage Data: Information about how you interact with the Platform, including pages visited, features used, actions taken, campaign performance data, time spent, clickstream data, and search queries within the Platform.
  • Device and Technical Data: IP address, browser type and version, operating system, device identifiers, screen resolution, language preferences, and referring URLs.
  • Log Data: Server logs that record requests made to our servers, including timestamps, API endpoints accessed, response codes, and error information.
  • Cookies and Similar Technologies: We use cookies, web beacons, pixels, and similar tracking technologies to collect information about your browsing behavior and preferences. See Section 8 for details.

2.3 Information from Third-Party Integrations

When you connect third-party accounts to the Platform (including social media platforms, ad networks, email service providers, messaging platforms, and CRM systems), we receive information from those services as authorized by your integration settings. This may include:

  • Social media account metrics, post performance data, audience demographics, and engagement analytics.
  • Ad campaign performance data, spend data, conversion data, and audience information from ad networks.
  • Email delivery data, open rates, click rates, bounce rates, and subscriber information from email service providers.
  • Messaging interaction data from WhatsApp, Telegram, Facebook Messenger, and other messaging integrations.
  • Contact and lead information from connected CRM systems.

2.4 Information Generated by AI Systems

Our AI systems generate derived information based on your data, including:

  • Contact intelligence scores, behavioral analyses, psychographic profiles, conversion propensity predictions, and other AI-generated assessments.
  • AI-generated content including images, videos, text, and marketing materials.
  • Strategy recommendations, competitive analyses, and performance predictions.
  • Reasoning traces documenting AI decision-making processes.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Service Delivery: To operate, maintain, and provide the features and functionality of the Platform, including AI content generation, publishing, ad campaign management, mass campaign delivery, contact intelligence, analytics, and voice interaction.
  • AI Model Operations: To route your requests to appropriate AI providers, generate content, perform analyses, produce recommendations, and execute autonomous marketing operations on your behalf.
  • Account Management: To create and manage your account, authenticate your identity, process payments, and manage your subscription.
  • Communication: To send you service-related notices, daily briefings, approval requests, competitive alerts, billing notifications, and to respond to your support requests.
  • Improvement and Development: To analyze usage patterns, diagnose technical issues, improve Platform performance, develop new features, and enhance the user experience.
  • Security and Fraud Prevention: To detect, investigate, and prevent fraudulent, unauthorized, or illegal activity, and to protect the security and integrity of the Platform.
  • Legal Compliance: To comply with applicable laws, regulations, legal processes, and governmental requests.

4. How We Share Your Information

4.1 AI Service Providers

To provide AI-powered features, we transmit certain data to third-party AI providers. This may include content prompts, business context, contact data (in anonymized or pseudonymized form where feasible), and campaign parameters necessary for AI content generation, analysis, and decision-making. We select AI providers that maintain commercially reasonable security practices, but we cannot guarantee the security practices of third-party AI providers. Data sent to AI providers may be subject to their respective privacy policies and terms of service.

4.2 Third-Party Service Integrations

When you authorize integrations with third-party platforms (social networks, ad networks, email providers, messaging services), we transmit data to those platforms as necessary to perform the integrated functions you have configured. Such data sharing is governed by the terms and privacy policies of those third-party platforms.

4.3 Payment Processors

We share payment information with our payment processing partners (e.g., Stripe) to process transactions. These processors have their own privacy policies governing their use of your information.

4.4 Service Providers and Subprocessors

We engage third-party companies and individuals to perform services on our behalf, including hosting, data storage, analytics, customer support, and email delivery. These service providers have access to your information only to perform tasks on our behalf and are obligated to maintain its confidentiality.

4.5 Legal Requirements and Protection

We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe in good faith that disclosure is necessary to: (a) comply with a legal obligation; (b) protect and defend our rights or property; (c) prevent fraud or other illegal activity; (d) protect the personal safety of users or the public; or (e) protect against legal liability.

4.6 Business Transfers

In connection with any merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred to the acquiring entity. We will provide notice before your information becomes subject to a different privacy policy.

4.7 With Your Consent

We may share your information for other purposes with your explicit consent.

5. Data Retention

We retain personal information while needed to provide the Service and for applicable legal obligations, dispute resolution and security purposes. Retention differs by data domain and deployment configuration. Billing, consent and audit records may require a different retention period from generated content or application activity.

Contact and lead data, reasoning traces, exports and provider copies are not governed by a single automatic deletion timer. Request the applicable domain coverage and retention exceptions before account termination. Do not rely on continued account access after termination as your export mechanism.

You may request deletion of your data at any time (see Section 7).

6. Data Security

The Platform uses organization membership checks, role-based authorization, explicitly scoped application data access and supported API/webhook authentication. OIDC login and TOTP MFA depend on the configured identity provider. These mechanisms are not a claim of dedicated tenant infrastructure, database-enforced isolation on every query, complete immutable logging or independent security certification.

Encryption, key rotation, backups, monitoring and retention workers depend on deployment configuration. Review the security scope and procurement prerequisites for the evidence to request. AI and channel providers have their own data processing and security terms.

Despite these measures, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security of your information. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

7. Your Rights and Choices

7.1 Access and Portability

You may request access to the personal information we hold about you and receive a copy of your data in a structured, commonly used, machine-readable format.

Organization exports cover the entities listed in their export manifest; a separate subject workflow covers Contact and CDP records. An export is not a universal archive of every integration. Verify the manifest and domain coverage for your request.

7.2 Correction

You may request that we correct any inaccurate or incomplete personal information.

7.3 Deletion

You may request deletion of your personal information, subject to applicable exceptions such as legal retention obligations. Account termination is not evidence that all records have been erased. Our scoped application workflows require coverage review; third-party provider copies, backups and retained billing/audit records require separate handling. Contact us for the request's status, domain coverage and any retention exceptions. Applicable statutory rights and deadlines continue to apply.

The local subject-erasure workflow covers directly organization/contact-linked application records, Contact cascade records, and CDP records and consents. It invalidates applicable exports and retains a minimal erasure marker and keyed identifier digests to recognize erased identifiers. Unlinked free-form content, provider-held email/SMS/voice/social data, generated media objects, backups and infrastructure logs require separate review. A local scope receipt is not confirmation that those external or unlinked records were removed.

7.4 Restriction and Objection

You may request that we restrict the processing of your personal information or object to certain types of processing, including processing for direct marketing purposes.

7.5 Withdrawal of Consent

Where processing is based on consent, you may withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing prior to withdrawal.

7.6 Automated Decision-Making

The Platform uses AI to make marketing recommendations and, where configured and authorized, execute actions. You may request human review and information about significant automated decisions as provided by applicable law. Available approval records and reasoning traces can support review, but may not cover every data source or action and do not by themselves establish compliance with automated-decision requirements. A queued offline decision is not an accepted server decision.

7.7 Exercising Your Rights

To exercise any of these rights, contact us at privacy@ultimatenexus.ai. We will respond to your request within 30 days (or such shorter period as required by applicable law). We may need to verify your identity before fulfilling your request.

8. Cookies and Tracking Technologies

We use cookies and similar technologies for the following purposes:

  • Essential Cookies: Required for Platform operation, authentication, and security.
  • Analytics Cookies: Help us understand how users interact with the Platform to improve performance and features.
  • Preference Cookies: Store your settings and preferences for a personalized experience.

You can control cookies through your browser settings. Disabling certain cookies may limit Platform functionality.

9. International Data Transfers

Your information may be processed in countries other than your country of residence, including the United States, depending on the configured hosting and providers. These countries may have different data protection laws. Before transferring regulated data, confirm the relevant processing regions, data-processing agreement and applicable transfer mechanism with us. A product integration does not by itself establish that standard contractual clauses or another required safeguard are in place.

10. Children's Privacy

The Service is not directed to individuals under 18 years of age. We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child under 18, we will take steps to delete that information promptly.

11. Third-Party Links and Services

The Platform may contain links to or integrations with third-party websites and services. This Privacy Policy does not apply to third-party services. We encourage you to review the privacy policies of any third-party services you access through the Platform.

12. AI-Specific Data Practices

12.1 AI Input Data

Data you provide or that is generated through your use of the Platform may be sent to third-party AI providers as input for content generation, analysis, and decision-making. We minimize the data sent to what is necessary for the requested operation.

12.2 AI Output Data

Content and analyses generated by AI systems on your behalf are treated as your data and are subject to the same protections described in this Privacy Policy. AI-generated outputs may not be unique and similar outputs may be generated for other users.

12.3 Model Training

We do not use your proprietary business data, contact data, or marketing content to train general-purpose AI models. Third-party AI providers may have their own policies regarding training data; we select providers that offer enterprise-grade data handling and, where available, opt out of training data programs on your behalf.

12.4 Voice Data

When you use voice interaction features, audio is processed by speech recognition services to convert to text. We may retain transcriptions of voice interactions for service delivery and quality purposes. Audio recordings are processed in real-time and are not stored long-term unless required for dispute resolution or compliance.

13. California Privacy Rights (CCPA/CPRA)

California residents have additional rights under the California Consumer Privacy Act and California Privacy Rights Act, including the right to know what personal information we collect and how it is used, the right to delete personal information, the right to opt out of the sale or sharing of personal information, and the right to non-discrimination for exercising privacy rights. 14. European Data Subject Rights (GDPR)

If you are in the European Economic Area, United Kingdom, or Switzerland, you have rights under the General Data Protection Regulation, including access, rectification, erasure, restriction of processing, data portability, and objection. Our legal bases for processing include contract performance, legitimate interests, consent, and legal obligations. You may lodge a complaint with your local data protection authority. 15. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on this page and updating the "Last Updated" date. For significant changes, we may provide additional notice via email or through the Platform. Your continued use of the Service after changes become effective constitutes your acceptance of the revised policy.
